These terms and conditions apply to any Order that you place with Yippee! Experiences Limited. We advise that you read them carefully and keep a copy.
1) Definitions and Interpretation
In this Agreement the following terms shall have
the following meanings:
"Booking Conditions" means the
booking conditions, procedures and
restrictions in respect of an Experience
described in the Brochure and in the
Voucher for that Experience;
"Brochure" means our most recent
Brochure in respect of the
Experiences as published in hard
copy and/or on our Website;
"Essential Information" means, the
information that appears as part of
the description of the Experience, also
forms part of the Terms & Conditions.
"Experience" means the Experience
day or gift Experience provided by
us or on our behalf;
"Order" means an order for a Voucher;
"Provider" means the third party
who provides the Experience on
our behalf;
"Unavoidable Events" means any
events beyond our reasonable control
that we are unable to reasonably
prevent, insure against or avoid
(including, but not limited to,
adverse weather conditions, natural
disasters, fire, the failure or delay of
supplies of power, fuel, transport,
equipment or other goods and
services, strikes, acts of terrorism,
riots and military action);
"Validity Period" means the period
stated on the Voucher for which the
Voucher remains valid; and
"Voucher" means a Voucher issued
by us that entitles the holder to
participate in an Experience.
"Website" means our Website at
www.yippee-experiences.com
Headings in these Terms and
Conditions are included for
convenience only and shall not
affect the construction or interpretation
of these Terms and Conditions.
2) Placing an Order
To place an Order you must follow
the steps set out in our Brochure.
The appearance of an Experience in
our Brochure is an invitation to you
to make an offer to purchase a Voucher
for that Experience by placing an
Order. We have the right to refuse
any Orders and no contract will
subsist between you and us unless
and until we accept your Order.
We will be deemed to have accepted
your Order only when we send you
written confirmation that we have
accepted your Order, when we accept
payment for your Order or when we
send you your Voucher.
Vouchers are subject to availability.
If we do not supply a Voucher to you
for any reason, we will not charge
you for that Voucher and will refund
any money actually paid for it.
Each Yippee! Voucher is valid for
10 months from the date of purchase,
unless otherwise stated in the
Essential Information.
3) How to pay for your Voucher
The prices for the Vouchers and any
delivery charges are set out in our
most recent Brochure (a copy of which
will be posted on our Website) and
are stated in UK Pounds Sterling.
These prices include VAT.
Whilst we try to ensure that these
prices are accurate, mistakes may
sometimes occur. If we discover a
mistake in the price of an Order we
will contact you as soon as possible
and give you the option to either
proceed with the Order at the correct
price or to cancel your Order. If we
cannot contact you we will treat your
Order as having been cancelled.
If your Order is treated as being
cancelled in this way we will not
charge you for that Order and will
refund any money actually paid for it.
The cost of any Order must be paid
by you in full before delivery of the
Voucher using a credit or debit card
acceptable to us.
4) Delivery of your Voucher
Subject to you paying the applicable
delivery charges set out in our
Brochure, we will deliver your Voucher
to you at the delivery address given
in your Order within the timescales
set out in our Brochure. However,
because delay is sometimes outside
of our control, time of delivery will
not be of the essence. If you have
not received your Voucher within
21 days of the date that you placed
your Order, you may contact us at
the contact details (See clause 16)
quoting your Order reference number
and cancel your Order. If you cancel
your Order in this way we will not
charge you for your Order and will
refund any money actually paid for it.
All Yippee! Experiences must be
booked with the Experience Provider
at least four weeks in advance,
unless otherwise stated in the Booking
Conditions or Essential Information.
5) Your statutory right to cancel an Order
You may cancel your Order within
7 business days after the date that
you receive your Voucher. If you cancel
your Order in this way we will give
you a full refund of the money actually
paid for it. If you decide to cancel
your Order within this time you must
return the Voucher to us unused and
in good condition within 21 business
days after the date that you received it.
6) Experiences
We will provide Experiences in
accordance with the description of
the Experiences in the Brochure.
Experiences are subject to availability.
Whilst we try to ensure that the
description of the Experiences in the
Brochure are accurate, mistakes may
sometimes occur. If we discover a
mistake in the description of an
Experience that you have ordered a
Voucher for we will contact you as soon
as possible and give you the option
to cancel your Voucher. If you cancel
your Voucher in this way we will
refund any money actually paid for it.
In addition to the Booking Conditions
and these Terms and Conditions,
your receipt of, or participation in
certain Experiences may be subject
to additional terms and conditions
(such as health and safety and security
rules). We will let you have a copy of
these with your Voucher. If you do not
accept these additional Terms and
Conditions you may contact us at the
contact details (See clause 16) quoting
your Order reference number and
cancel your Voucher within 7 business
days after the date that you receive
your Voucher. If you cancel your
Voucher in this way we will refund
any money actually paid for it.
7) Vouchers
If you lose your Voucher we shall not
be obliged to provide you with a
refund or a replacement Voucher.
We acknowledge that you may wish
to give your Voucher to another
person so that person may
participate in an Experience. If you
do so, you must give the person that
you give your Voucher to a copy of
these Terms and Conditions, and
this Agreement will be treated as
having been transferred to that
person as if they ordered the
Voucher from us themselves.
You may not sell the Voucher to any
third party, and we reserve the right
to cancel any Voucher and/or cancel
any agreement between you and us
where we reasonably believe that
you have sold a Voucher to any third
party. If we cancel any Voucher and/or
cancel any agreement between you
and us in this way we willnot refund
any money already paid for it.
8) Exchanging your Voucher
Provided that the Validity Period for
your Voucher has not expired and
you have not already made a booking
to redeem your Voucher, you may
exchange your Voucher for a Voucher
for another Experience by contacting
us at the contact details (See clause 16).
The Validity Period of the replacement
Voucher shall be the same as the
Validity Period of the Voucher that
you ordered. If the price of the
replacement Voucher is less than the
price of the Voucher that you ordered,
we will issue a credit note for the
difference for you to redeem against
the price of any additional Vouchers
that you may order. If the price of
the replacement Voucher is greater
than the price of the Voucher that
you ordered, then the difference must
be paid by you in full before delivery
of the Voucher using a credit or
debit card acceptable to us.
9) Extending the Validity Period of your Voucher
Provided that the Validity Period for
your Voucher has not expired and
you have not already made a booking
to redeem your Voucher, you may
request that the Validity Period for
your Voucher be extended. We reserve
the right to refuse to extend the
Validity Period. If we agree to extend
the Validity Period, we may charge
you an additional fee to reflect any
increase in the price of that Voucher,
the period for which the Validity
Period has been extended and a fee
of £15 to reflect our administrative
costs in dealing with your request.
10) Making a Booking
All Vouchers are valid for 10 months
from the date of purchase and
are subject to the Booking
Conditions and these Terms and
Conditions. You may redeem your
Voucher in accordance with the
Booking Conditions.
11) Cancelling of Bookings
You may cancel a booking up to 21
days before the date of the booked
Experience. If you cancel a booking
in this way, we shall charge you a 10%
fee (min of £15 and a max of £50) to
reflect our administrative costs in
dealing with your cancelled booking
and you will be able to make another
booking with your Voucher.
If you cancel a booking less than 21
days before the date of the booked
Experience we shall charge you a
10% fee (min £15 and a max of £50)
to reflect our administration costs.
We may also cancel your Voucher,
in which case you will no longer be
able to use the Voucher and we will
not be obliged to provide any refund
for that Voucher.
12) Unavoidable Events
You acknowledge that sometimes
we and the Providers will be unable
to provide the Experiences due to
Unavoidable Events.
If you have made a booking to
redeem your Voucher in accordance
with the Booking Conditions, but we
or our Providers are unable to provide
the Experiences due to Unavoidable
Events, we will let you know as soon
as reasonably practicable and you
will be entitled to either:
make another booking to
redeem your Voucher, in which
case we will extend the Validity
Period for a reasonable period
at no additional cost or expense
to you; or
cancel your Voucher, in which
case we will refund any money
actually paid for it.
13) Complaints
If you have any complaints about
your participation in an Experience
you can contact us at the details
(See clause 16).
14) Liability
Save as provided in this clause 14,
in the event that we are in breach of
any agreement between us and you
we shall not be liable to you for any
loss, damage cost or expense arising
out of that breach that was not
reasonably foreseeable by us at the
date of this agreement.
Nothing in these Terms and
Conditions shall limit or exclude
our liability:
for death or personal injury
resulting from negligence;
for fraud or fraudulent
misrepresentation;
for damage suffered by you
as a result of any breach by us of
the conditions as to title and
quiet enjoyment implied by
English law;
for damage for which we are
liable to you under Part 1 of the
Consumer Protection Act 1987;
or for any other liability the
exclusion or limitation of which
is not permitted by English law.
15) General
We may assign, transfer, mortgage,
charge, sub-contract, sub-licence or
otherwise dispose of the whole, or
any part of any agreement between
you and us and/or the provision of
any Experiences without your
prior consent.
The remedies available to either
you or us under these Terms and
Conditions shall not limit or exclude
any other rights that you or we may
have against each other.
Any failure by either of us to enforce
any rights under these Terms and
Conditions shall not affect either
your or our right to enforce them at
a later date.
If any provision or right under these
Terms and Conditions is found to
be invalid or unenforceable then
the remaining provisions or rights
under these Terms and Conditions
shall be unaffected as if such invalid
or unenforceable part did not exist.
These Terms and Conditions contain
all the Terms and Conditions between
you and us regarding your Order and
your participation in the Experiences.
You should be aware that if any term
that you believe has been agreed
between us does not appear in these
Terms and Conditions you may
have difficulty in enforcing such term.
Nothing in this Agreement shall
give any right or benefit to any
person who is not a party to it.
Notwithstanding that any agreement
between you and us relating to your
Order may not have been concluded
face-to-face, you and we agree that
it has been concluded in England in
writing. Any such agreement is
governed by English law and you and
we each hereby accept the exclusive
jurisdiction of the English Courts.
